Terms of Service
- Puffulet is a habit and wellness app, not medical advice. Exercise within your limits.
- Subscriptions are bought and managed through Apple, renew automatically, and can be cancelled anytime in the App Store. A free trial becomes a paid subscription unless you cancel at least 24 hours before it ends.
- Your clips and text are yours. You let us process them only to run the app.
- Be fair: don't abuse the service or try to get around its limits.
- If you live in the EU, the UK or another place with consumer protection laws, nothing here takes those rights away.
1. Agreement
These Terms are an agreement between you and InvestTechNick SRL, a company registered in Romania (registered address, trade register no. J__/____/____, tax ID RO________) (“we”, “us”). They cover the Puffulet app, puffulet.com and related services (the “Service”). They are also the end-user licence agreement for the app.
By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you don't agree, please don't use the Service.
2. Who can use Puffulet
- You must be at least 16 years old, or older if your country requires it to agree to these Terms yourself.
- You sign in with Apple or Google. Keep your Apple ID or Google account secure: you're responsible for what happens in your Puffulet account.
- One person per account. Your account and your pet can't be sold or transferred.
3. Health and safety
Puffulet is not a medical device and does not give medical advice. Its targets for exercise, breathing and water are general wellness suggestions, not prescriptions, and may not suit you.
- Talk to a doctor before starting a new exercise or breathing routine, especially if you are pregnant or have a heart, lung, joint, kidney or other medical condition, or take medication that affects fluid intake.
- Stop immediately if you feel pain, dizziness, shortness of breath or discomfort. Breathing exercises can cause light-headedness; do them sitting down.
- Don't drink more water than is comfortable or than your doctor recommends.
- Choose a safe place to record. Never use Puffulet while driving or when your attention is needed elsewhere.
- Puffulet's alarm and reminders are a convenience. Don't rely on them for anything critical, such as taking medication or getting to an important appointment on time.
4. The service and AI check-ins
- Puffulet helps you plan daily habits. You check in by recording a short clip, which an AI model checks automatically (see the Privacy Policy).
- Automated checks can make mistakes. Puffulet is designed to give you the benefit of the doubt, and you can count a check-in it rejected with “I really did it” (within daily limits). Your pet, scores and streaks are for motivation only and have no value outside the app.
- Check-ins need an internet connection, and there are daily limits per activity to keep the service sustainable.
- We keep improving Puffulet, so features may change. We won't take away a core feature you're paying for during a paid period without telling you and, where the law requires, giving you a remedy.
5. Subscriptions, free trials and offers
- What's included. A subscription unlocks Puffulet's check-ins and features for as long as it's active.
- Payment through Apple. Subscriptions are sold and billed by Apple through your Apple ID, under Apple's Media Services Terms. The price, in your currency and including applicable taxes, is shown before you confirm.
- Automatic renewal. Your subscription renews automatically for the same period (monthly or yearly) at the then-current price, and your Apple ID is charged within 24 hours before the end of each period, unless you cancel at least 24 hours before the period ends.
- Free trials. If a plan includes a free trial (for example, 3 days), you won't be charged during the trial. Unless you cancel at least 24 hours before the trial ends, it turns into a paid subscription and you're charged the plan's price. We remind you in the app a day before. Free trials are for new subscribers, once per Apple ID.
- Special offers. We may occasionally offer discounted plans (such as a one-time offer) or offer codes. The terms shown with the offer apply, and an offer can't be combined with another unless it says so.
- Price changes. If we raise the price of your subscription, Apple will notify you in advance and, where required, ask for your consent. You can cancel before the new price applies.
- Managing and cancelling. Manage or cancel anytime in iPhone Settings › your name › Subscriptions, or in Puffulet › Settings › Manage subscription. Cancelling stops the next renewal; you keep access until the end of the period you've paid for. Deleting the app or your account does not cancel your subscription.
- Free access. We may give some accounts free access (for example testers or reviewers). We can end free access at any time.
6. Cancellation, refunds and the right of withdrawal
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We can't issue refunds for App Store purchases ourselves.
- EU, EEA and UK consumers have a 14-day right to withdraw from distance contracts. For App Store purchases, you can exercise it through Apple at the link above. If you start using a paid subscription immediately, you agree that the service begins during the withdrawal period. Where the law allows, you may then lose the right of withdrawal for the part already provided, or pay for it proportionally.
- Nothing in these Terms limits your statutory rights if the Service is faulty or not as described.
7. Your content
- The clips you record, and the text you write (such as affirmations), remain yours.
- You give us a worldwide, non-exclusive, royalty-free licence to store, process and transmit them only to provide the Service to you, including having them checked by our AI provider. The licence ends when the content is deleted. We don't use your clips for advertising or to train AI models.
- Only record yourself. Don't film other people without their permission, and don't record anything illegal, harmful or sexually explicit.
- If you send us feedback or ideas, we may use them freely, without owing you anything.
8. Acceptable use
You agree not to:
- copy, modify, reverse engineer or decompile the app, except where the law allows it despite this restriction;
- access the Service with bots, scripts or modified apps, or call our servers or AI checks other than through the official app;
- get around subscription checks, daily limits or security measures, or use the Service to overload or attack our systems or our providers;
- use the Service for anything illegal, to harass others, or to infringe others' rights;
- resell or commercially exploit the Service.
We may suspend or limit an account that breaks these rules, with notice where reasonable.
9. Our app and your licence
Puffulet, the Puffy character, artwork, animations, voice lines, text, software and trademarks belong to us or our licensors. We give you a personal, revocable, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as allowed by the App Store usage rules, for your own non-commercial use. We keep all rights not expressly granted.
10. Ending your use
- You can stop using Puffulet and delete your account anytime: Settings › Delete account. See Delete your account.
- We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Service. Unless we stop because you broke these Terms, we'll give you reasonable notice. If we discontinue the Service for everyone, we'll help you get a refund for any unused prepaid period, to the extent Apple allows.
- Sections that by their nature should survive (such as liability and disputes) continue after termination.
11. Disclaimers
We work hard to keep Puffulet running well, but we provide it “as is” and “as available”, and don't promise it will be uninterrupted, error-free, or that it will achieve any particular health or fitness result. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. If you're a consumer in the EU, the UK or another country that gives you statutory guarantees, those guarantees still apply and this section doesn't limit them.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid for Puffulet in the 12 months before the claim, or USD 50 (or the equivalent in your currency).
Nothing in these Terms limits liability that can't be limited by law, including for death or personal injury caused by negligence, for fraud, or for intent or gross negligence. EU and UK consumers keep their full statutory rights.
13. Governing law and disputes
If something goes wrong, please contact us first at [email protected]. Most issues can be solved quickly, and we'll try to resolve yours within 30 days.
- Everyone: these Terms are governed by the laws of Romania, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
- EU, EEA, UK and Swiss consumers: you also keep the protection of the mandatory laws of the country where you live, and you can bring proceedings in the courts there or in Romania.
- US consumers: you keep any rights your state's law gives you that can't be waived. You may bring a claim in small-claims court in your county of residence. There's no mandatory arbitration and no class-action waiver in these Terms.
- Everyone else: the courts of Bucharest, Romania have jurisdiction, unless the law of your country gives you the right to sue at home.
California residents: you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
14. Apple App Store terms
If you downloaded Puffulet from the Apple App Store:
- These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- We are solely responsible for maintenance and support of the app. Apple has no obligation to provide any.
- If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to meet a warranty are our responsibility, to the extent not effectively disclaimed.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims the app or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Our contact details for questions, complaints or claims about the app are in section 17.
- You must comply with applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
15. Changes to these Terms
We may update these Terms, for example when we add features or the law changes. For significant changes, we'll tell you in the app or by email at least 30 days before they take effect, unless the change is legally required sooner. If you don't agree, you can stop using Puffulet and cancel your subscription before the change applies. Continuing to use it after that means you accept the new Terms.
16. General
- These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- If any part is found unenforceable, the rest stays in effect.
- If we don't enforce a right straight away, we haven't waived it.
- We may transfer these Terms to a company that takes over Puffulet, and your rights won't be reduced. You may not transfer them without our consent.
- We may provide translations. If a translation differs from the English text, the English text applies, unless the law where you live says otherwise.
